Terms of Service

Effective March 28, 2026

These Terms of Service ("Terms") govern your use of Fidant.AI ("the Service"), operated by Fidant AI Ltd. ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

01The Service

Fidant.AI is an AI assistant with persistent memory for executives. The Service allows you to have conversations with frontier AI models (Claude, GPT, Gemini) while maintaining a persistent context layer that carries knowledge across conversations. Your context data is stored on your personal Google Drive.

The Service is provided "as is" and "as available." We do not guarantee that AI-generated responses are accurate, complete, or suitable for any particular purpose. You are solely responsible for decisions made based on information provided by the Service.

02Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement. The Service is intended for professional and personal productivity use by individuals.

03Your Account

You sign in using your Google Account. You are responsible for maintaining the security of your Google Account credentials. You agree to notify us immediately if you become aware of unauthorized access to your account.

You may have only one active account. Creating multiple accounts to abuse free trials or circumvent usage limits is a violation of these Terms and may result in account termination.

04Your Data

You own your data. Your memory files, conversation history, and context documents are stored on your personal Google Drive. We do not claim ownership of any content you create or store through the Service.

By using the Service, you grant us a limited license to access, read, and modify files within the Fidant.AI folder on your Google Drive solely for the purpose of providing the Service. This license terminates when you revoke access or delete your account.

You grant us a limited license to send your messages and context data to third-party AI model providers (Anthropic, OpenAI, Google) to generate responses. We use API access, not consumer products — these providers do not use your data for model training under their standard API terms.

05Subscriptions & Billing

Fidant.AI offers a free trial and paid subscription tiers. The current tiers, pricing, and included features are displayed on our website and may change with notice.

Paid subscriptions are billed monthly through Stripe. You may cancel at any time — your subscription remains active until the end of the current billing period. We do not offer refunds for partial months.

We reserve the right to change pricing with 30 days' notice. Price changes do not affect your current billing period.

06Acceptable Use

You agree not to use the Service to:

07AI Limitations & Disclaimer

The Service uses third-party AI models to generate responses. AI outputs may be inaccurate, incomplete, or inappropriate. The Service does not provide medical, legal, financial, or professional advice. Always consult qualified professionals for important decisions.

We do not guarantee the accuracy or reliability of any AI-generated content, including but not limited to health data interpretation, financial analysis, or strategic recommendations.

08Health Data

The Service includes features for tracking health biomarkers and lab results. This is for personal informational purposes only and does not constitute medical advice, diagnosis, or treatment. The Service is not a medical device.

Health data you upload is stored on your Google Drive. Unit conversions and status indicators are computed algorithmically and may contain errors. Always verify health data with your healthcare provider.

09Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Fidant AI Ltd. and protected by intellectual property laws. Your subscription grants you a personal, non-transferable, non-exclusive license to use the Service for its intended purpose.

10Limitation of Liability

To the maximum extent permitted by law, Fidant AI Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11Third-Party Services

The Service integrates with third-party services including Google (authentication, Drive storage), Anthropic, OpenAI, and Google AI (model providers), and Stripe (payments). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

12Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your account for violation of these Terms or for any other reason with 30 days' notice (or immediately in cases of abuse or illegal activity).

Upon termination, your Google Drive data remains yours. Server-side account data is deleted within 30 days.

13Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.

14Governing Law

These Terms are governed by and construed in accordance with the laws of the Astana International Financial Centre (AIFC), Kazakhstan. Any disputes shall be resolved through the AIFC Court.
